1. Introduction
By accessing or using the ZimlyMart platform (zimlymart.co.zw), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. ZimlyMart reserves the right to update these terms at any time. Continued use of the platform following any changes constitutes acceptance of the revised terms.
2. Services Provided
ZimlyMart provides an online grocery ordering and delivery service operating in Harare, Zimbabwe. We act as an intermediary between customers and local suppliers. We source grocery items on your behalf following order confirmation and payment, and coordinate delivery to the address specified during checkout. ZimlyMart does not hold standing inventory β items are sourced after each order is placed.
3. Orders and Payments
All orders must be placed through the ZimlyMart website. An order is only confirmed once payment has been successfully processed. Payments are handled securely via PayPal and are denominated in USD. ZimlyMart reserves the right to cancel any order that cannot be fulfilled, in which case a full refund will be issued. Order confirmation is sent via email and WhatsApp after payment is completed.
4. Pricing
Prices displayed on the ZimlyMart platform are in USD and are subject to change without notice. Delivery fees are calculated based on the customer's selected suburb and delivery type (Express, Same-Day, or Next-Day). The total amount displayed at checkout includes the product subtotal, delivery fee, and any applicable discounts. ZimlyMart makes every effort to ensure pricing accuracy but reserves the right to correct errors at any time prior to order fulfilment.
5. Delivery Policy
ZimlyMart delivers within a 15 km radius of Harare CBD. Delivery options include Express (~2 hours), Same-Day (orders placed before 10 AM), and Next-Day. Delivery times are estimates and not guaranteed. ZimlyMart is not liable for delays caused by unforeseen circumstances including traffic, adverse weather, or supplier delays. It is the customer's responsibility to ensure that a valid and accessible delivery address is provided. ZimlyMart will attempt delivery to the specified address once. If no one is available to receive the order, additional arrangements must be made via WhatsApp.
6. Customer Responsibilities
Customers are responsible for providing accurate recipient details including name, phone number, and delivery address. Customers must ensure the recipient is available to receive the delivery. Customers using the platform agree not to misuse promotional codes, create multiple accounts to circumvent usage limits, or submit fraudulent orders. ZimlyMart reserves the right to suspend accounts that engage in abusive or fraudulent behaviour.
7. Refunds
Refunds are issued in the following circumstances: if an item ordered is unavailable and no suitable substitute is agreed upon; if an order is cancelled by ZimlyMart prior to fulfilment; or if a confirmed delivery fails due to an error on ZimlyMart's part. Refunds are processed back to the original payment method within 5β10 business days. Refund requests must be submitted within 24 hours of the scheduled delivery window via WhatsApp or email. ZimlyMart does not offer refunds for orders where the recipient was unavailable at the delivery address.
8. Limitation of Liability
ZimlyMart's liability is limited to the value of the order in question. We are not liable for indirect, incidental, or consequential damages arising from the use of our platform or any failure in delivery. ZimlyMart does not guarantee continuous or uninterrupted access to its platform and is not responsible for losses resulting from technical downtime.
9. Changes to Terms
ZimlyMart reserves the right to modify these Terms of Service at any time. Changes take effect immediately upon publication on this page. Customers are encouraged to review these terms periodically. Continued use of the platform after changes are published constitutes your acceptance of the updated terms. For significant changes, ZimlyMart will endeavour to notify customers via email or WhatsApp.
